ASSUMPTION OF RISK 

I HEREBY ASSUME ALL OF THE RISKS OF PARTICIPATING IN Mars Hill Full Gospel Assembly’s (hereinafter FGA) Events and Services, including but not limited to any risk that might arise from negligence or carelessness on the part of the persons or entities being released, because of their possible liability without fault, through participation in this FGA event and/or future events held by FGA and not limited to outside events, but including events held inside building of FGA as well. 

I certify that I and any children in my custody or care are physically well and no qualified medical professional has advised me or any children in my custody or care to not participate or to stay home in quarantine or isolation. I certify that there are no health-related reasons or problems which preclude my or any children in my custody or care participation in this activity, and or future events by FGA. 

I realize there are potential physical dangers, hazards, considerable risk and death to me in my use/participation in this event/use of this facility, equipment and programs therein, and also due to actions of other participants and my proximity to them in these areas.

WAIVER AND RELEASE OF LIABILITY 

A. I WAIVE, RELEASE, AND DISCHARGE, FGA and their directors, officers, employees, volunteers, representatives, and agents from any and all liability, including but not limited to, liability arising from negligence or fault of the agents of FGA or other participants of FGA Events and Services, for any real or perceived exposure to COVID-19, illness, death, disability, personal injury, property damage, or actions of any kind which hereafter occur to myself or my child(ren) at any time including during our travel to and from this activity. 

B. I INDEMNIFY, HOLD HARMLESS, AND PROMISE NOT TO SUE the entities or persons mentioned in this Waiver and Release from Liability form from any and all liabilities or claims made as a result of participation in this activity, whether caused by the negligence of release or otherwise. I acknowledge that FGA is NOT responsible for the errors, omissions, acts, or failures to act of any party or entity conducting specific activity on their behalf and FGA is not responsible for any real or perceived exposure to COVID-19. 

I acknowledge that this activity may involve direct physical contact with individuals other than I and any children in my custody or care and my(our) immediate family and/or household members. I acknowledge that I am attending FGA Services of my own free will and FGA and their directors, officers, employees, volunteers, representatives, or agents did not force or compel me or any children in my custody or care to attend. I acknowledge that I (we) have been and will again be in public places, businesses, and in the presence of individuals other than those in my (our) household before and after these FGA Events. 

Therefore, in consideration of being permitted to utilize the facility/equipment and participate in activities with FGA, I do hereby agree to assume all the risks and responsibilities surrounding my participation there, and further, I do for myself, my heirs, and personal representatives(s) hereby agree to defend, hold harmless, indemnify and release; and forever hold harmless Mars Hill Full Gospel Assembly, its trustees, and all its officers, agents and employees from and against any and all claims, demands, and actions, or causes of action, which may result directly or indirectly from my participation at Mars Hill Full Gospel Assembly.

AUTHORIZATION FOR USE OF COMMENTS, PICTURES AND VIDEOS

FGA is hereby authorized to take or permit pictures or videos to be taken of me or any children in my custody or care for use by FGA in publications, newspapers, newsletters, its website, and/or on television for purposes of public relations for FGA. FGA shall also have the right to use any portion of any statement made by me or any children in my custody or care in any publication, newspaper, newsletter, or website. 

APPLICABLE OF LAW 

This waiver and release of liability shall remain in effect for the duration of one calendar year. This Waiver and Release from Liability form shall also apply to all minors and persons in my (our) legal care, custody, and control attending FGA Events and Services. This Waiver Release from Liability shall be construed broadly to provide a release and waiver to the maximum extent permissible and governed by the laws of the State of Maine and supersedes any and all previous oral or written promises or agreements. 

SEVERABILITY CLAUSE 

I acknowledge this Waiver and Release is reasonable, valid, and enforceable. However, if any term, covenant, condition, or provision of this Waiver and Release is held by a court of competent jurisdiction to be invalid, void, or unenforceable, it is the intent of all parties that such provision is severable and the remainder of this Waiver and Release will in no way be affected, impaired, or invalidated as a result. 

I CERTIFY THAT I HAVE READ THIS RELEASE AND WAIVER OF LIABILITY FORM AND I FULLY UNDERSTAND ITS CONTENT. I AM AWARE THAT THIS RELEASE OF LIABILITY IS A CONTRACT AND I SIGN IT OF MY OWN FREE WILL.
